Mum of Edinburgh schoolgirl crushed by wall set to receive out of court payout from council 7 years after her death

THE MUM of wall crush schoolgirl Keane Wallis-Bennett is to receive an out of court payout from council chiefs after her death, it has emerged.

Abbie Wallis, 41, had launched legal action against Edinburgh‘s local authority in a bid to hold someone accountable for her daughter’s changing room death.

And it has now emerged over three years after the case began at the city’s Court of Session it has been resolved out of court.

A Court of Session spokesperson said they had been notified by parties that the case had now settled.

It’s understood the size of the settlement paid to the mum will not be paid public.

‘TAKE RESPONSIBILITY AND APOLOGISE’

The case comes after a fatal accident inquiry in August 2017 ruled nobody was to blame.

A source previously said: “Abbie said before that she never expected anyone to be prosecuted over Keane’s death.

“She’s just wanted someone to take responsibility.”

Keane, 12, was killed when a 6ft gym wall fell on her at Liberton High in 2014.

A ten day probe ruled the “inherently unstable” barrier was cracked at the base and pupils leaning on it caused its collapse.

The crumbling gym hall has since been demolished and replaced.

Abbie had previously said in 2015: “I want someone to take responsibility and apologise. I hope this report will bring us a step closer to that happening.”

We revealed in 2018 how Abbie had launched the legal action.

A City of Edinburgh Council spokesperson said: “We want to express our deepest sympathies again to Keane’s family for their tragic loss however as this is a legal matter it would be inappropriate to comment further.”

Abbie and her lawyers Balfour and Manson declined to respond.
